Mandatory mediation in Florida divorce cases

When couples enter the family law system in Florida, they have no choice but to agree to mediation. The Law Office of Philip J. Schipani understands mediation can be something you are not familiar with, so you may need guidance. The general idea here is to talk through your issues and come to an agreement in order to minimize the time you spend in court.

The Florida Courts explain there are three people who are the main participants of a mediation session. You, your spouse and the mediator, who is a neutral third-party. You may also have attorneys representing each of you. The mediator is there to facilitate the negotiations. He or she is not a judge and does not make rulings or suggestions.

When beginning the process, the mediator will explain how it works and his or her role. You will be encouraged to discuss main points of your divorce settlement and to come to an agreement. Your session may end with an agreement on all the points of your divorce or only some of them. It is also possible to not reach an agreement.

While the main goal of mediation is to save time and prevent the courts from being clogged with family law matters, it also can help you to reach a more agreeable solution than what the court may render. It can also save you money and encourage an open dialogue between you and your spouse, which can be beneficial if you have children. To learn more about mediation, please visit our website.
