Be careful what you post on social media during divorce

Posting on Facebook, Twitter or Instagram during a family law proceeding can be a mistake.  Divorce and child custody are adversarial proceedings, and the other side will gather information to undermine your position.  One of the ways they will do this is by seeing what you post on social media. 

Here are some examples of posts that can work against you during a divorce or child custody proceeding:

  • What are you saying to your friends about your divorce or child custody proceeding?
  • Are you posting pictures of yourself? What do the pictures say about you?
  • Are you posting disparaging comments about your spouse?
  • Did you post something that is inconsistent with what you said in your court filings?
  • Did you take pictures of yourself in a bar on a day when you had custody of your children?
  • Did you go on a vacation with a boyfriend or girlfriend?
  • Did you spend marital assets on a new boat or motorcycle?

Even innocent pictures can be used against you in a family law case.  For example, if you take picture of your child playing with a toy gun, your spouse or their attorney could interpret the picture in a way you never intended.

To protect your rights during divorce, it’s important to seek legal advice about what you should and should not post on social media.
