Child custody options

If you are a parent going through a divorce in Florida, you are likely concerned about what will happen to your children. The first question that many parents have concerns the options that are available for child custody. We at The Law Office of Philip J. Schipani have detailed the types of custody that may be arranged and what each one will mean for you.


According to the American Bar Association, there are two different types of custody you may be granted: joint or sole. If you are given sole custody, you will be in charge of all major decisions made for the child as well as the physical residence and care. Your spouse will still most likely be given visitation rights and be able to take the child for overnight visits and vacations, barring any evidence of abuse.


If you are awarded joint custody, this means that you and your ex-spouse will share parenting responsibilities. This could mean either the right to make major decisions or the physical care of the child. While some families prefer an even time split with their children, many families with joint custody feel that too much switching is unhealthy for the children. In these situations, children may spend every other weekend with each parent or alternate homes on a monthly basis.
